The promotion opens at 12.01am on Monday 21 July 2014 and closes at 11.59pm, Sunday 14
September 2014 ("Promotional Period").
You must be 18 years or over to participate in the promotion. Liquor Licensing Laws apply.
PRIZE DETAILS
The prize is a trip for two people to the Hawke’s Bay in New Zealand and then to Bordeaux in
France (the "Prize Trip").
The Prize Trip includes:
- Return economy airfares for two people to Napier (New Zealand) and Bordeaux
(France). The winners travel to the first destination from the New Zealand commercial
airport closest to the Winner’s home, then onto the second destination and then they
return home.
- Twin share accommodation for up to eight nights (4 star where possible). Two nights in
Hawke’s Bay and six nights in Bordeaux.
- $1,800 NZD spending money per traveler.
By entering this Promotion you agree to these terms and conditions which include the
Prize details specified above. Any reference to Promotion in these terms and conditions
includes reference to the Prize Trip.
FULL TERMS & CONDITIONS
General
- Information on how to enter and prizes forms part of these conditions. By participating,
you agree to be bound by these conditions. Entries must comply with these conditions
to be valid.
- Entry is open to residents of New Zealand who are aged 18 years or over. Participants
may only enter in their own name and must be the authorised user of the email address
submitted at the time of entry. The Winner’s travelling companion must also be at least
18 years old.
- The promotion opens at 12.01am, 21 July 2014 and closes at 11.59:59pm, 14 September
2014 ("Promotional Period"). No late entries will be accepted.
- Employees (and their immediate family members) of the Promoter, its contractors,
participating promoters, agencies and participating retail outlets (their immediate family
members and agencies) are not eligible to enter this Promotion.
- You may enter as many times as you like but only one entry is permitted per purchase of
specially marked bottle of Church Road McDonald Series wine. Each entry must be
submitted separately. Each unique code may only be used once. Unrecognized codes will
be deemed invalid. Please keep your necktag with the unique code on it and your till
receipt showing proof of purchase.
- The main prize draw will take place on 29 September 2014. The first valid entry drawn
will win the Prize Trip. This prize draw will be random.
- The winner of this Promotion will be notified by 6 October 2014 by phone or email using
the details provided at the time of entry. Participants must ensure that their personal
details provided at the time of entry are correct. The Promoter accepts no responsibility
in the event that a winner cannot be contacted for any reason.
- In the event that a winner cannot be contacted by 6 October 2014 or is unable to take
the Prize, the prize will be forfeited and another winner will be drawn. These terms and
conditions will apply to any second or subsequent draw. This process will be followed
until the Prize is awarded to and accepted by an eligible participant.
- The winner and their place of residence will be announced on Facebook. For example
R.Penny from Grey Lynn.
- The Promoter will not be responsible for any late, lost or misdirected entries.
- Entry into this Promotion constitutes consent by the winner for the Promoter to use
their names and photographs for publicity purposes. The Promoter acknowledges that
use of any personal information will be subject to the Privacy Act 1993.
- Under the Privacy Act, you have the right to access and correct any personal information
held by Pernod Ricard New Zealand Limited.
- The Winner and their travelling companion may be required to provide their original
necktag with the unique code, proof of purchase, proof of identity, age verification and
sign a declaration confirming their eligibility to accept a prize. If the documentation
required by the Promoter is not received or the Winner or their Travelling Companion
has not been verified or validated to the Promoter’s (or its nominated agent’s)
satisfaction by 27 October 2014 then the Winner’s entry will become invalid, the prize
will be forfeited and another winner will be drawn. The prize will only be awarded
following any winner validation and verification that the Promoter requires in its sole
discretion.
- The prize (whether whole or in part) is non‐transferable and non‐redeemable for cash
(with the exception of the spending money). The Prize trip must be taken between 6 October 2014 and 1 October 2015. Some blackout dates may apply including September‐
October 2015 for the 2015 Rugby World cup.
- All components of the Prize Trip are subject to availability and may be altered by the
Promoter at any time.
- All bookings for the Prize Trip will be made through the Promoter’s agencies. Date
changes once booked are not permitted. Any extension or variation to the dates of
travel will not be permitted unless organised, arranged and agreed with the Promoter in
advance. Any additional nights’ accommodation (and associated expenses) is at the sole
expense of the Winner.
- The Winner’s Travelling Companion must travel with the Winner on the same itinerary
(including but not limited to flights and transfers). The cost of any alternative travel will
not be borne by the Promoter.
- The Promoter reserves the right to refuse to allow the Winner and/or their Travelling
Companion to take part in any or all aspects of the Prize if the Promoter determines, in
its absolute discretion, that the Winner and/or their Travelling Companion is not in the mental or physical condition necessary to be able safely to participate in the applicable
Prize
- Any elements of the Prize Trip not used by the Winner or their Travelling Companion for
any reason whatsoever including a reduction in the number of nights accommodation
due to flight or other transport scheduling, election not to participate by the Winner or
their Travelling Companion, refusal of entry or ejection from the Prize Trip, locations or
participation in certain activities for health, age, behaviour or safety reasons will be
forfeited and no compensation will be paid.
- Acceptance of a Prize is subject to any prevailing terms and conditions of the
accommodation/transport/services providers and, in particular, health, behaviour, age
and safety requirements. The Winner and their Travelling Companion may be required
by the Promoter to submit a medical certificate confirming their ability to accept and
travel on the Prize Trip in order to be awarded the Prize. Failure to submit a medical
certificate to the satisfaction of the Promoter may result in forfeiture of the Prize. In
such a case no compensation shall be payable.
- All ancillary and any other additional costs incurred by the Winner in the course of
taking the Prize (including but not limited to travel to the departing airport, items of a
personal nature, in‐room charges, meals and beverages not specified in the Prize details,
passports and visas) are the sole responsibility of the Winner and their Travelling
Companion. The Winner and their Travelling Companion must each hold a current
passport that is valid for at least 6 months after the proposed date completion of the
Prize Trip.
- The Promoter’s agent will provide advice regarding the Winner and their Travelling
Companion obtaining any relevant visas but the cost of those visas and the responsibility
for obtaining them shall be the responsibility of the Winner and their Travelling
companion.
- Basic travel insurance will be provided to the Winner and their Travelling Companion if
the winner and their nominated travelling companion are under 60 years of age and do
not have any pre‐existing medical conditions. If the Winner or their travelling companion
have a pre‐existing medical condition that person will receive a contribution of $150NZD
towards the cost of purchasing their own travel insurance.
- The Winner and their Travelling Companion must not engage in conduct of an immoral,
scandalous or illegal nature (including the use of banned drugs and substances) which
could bring themselves or the Promoter into disrepute. In such case the Promoter
reserves the right to terminate the Winner and or their Travelling Companion’s
participation in the Prize Trip and arrange for their immediate return to their country of
origin.
- The Promoter will not be liable for any loss or damage incurred by the Winner or
Travelling Companion (including indirect or consequential loss) or for any personal injury
suffered by any of them. The Winner and Travelling Companion will indemnify the
Promoter at all times against any costs, losses, claims or expenses incurred by the
Promoter as a result of any act or omission of the Winner or Travelling Companions.
- As a condition of accepting a Prize, each Winner (and their Travelling Companion) may
be required to sign any legal documentation as and in the form required by the
Promoter and/or suppliers of components of each Prize in their absolute discretion
including, but not limited to, legal releases and indemnity forms.
- 27. The Promoter will not be responsible for any incorrect or inaccurate information
concerning this promotion or any technical errors that may occur during administration
of this Promotion.
- The judges and Promoter’s decisions regarding any aspect of this Promotion is final and
no correspondence will be entered into. The Promoter may refuse to award the Prize to
any person, for any reason.
- The Promoter reserves the right to withdraw, vary, cancel or suspend this Promotion or
the Prizes without notice. The Promoter will not be responsible for, or liable to the
winner, if all or part of a prize is not available or must be varied or cancelled for any
reason. The Promoter is not responsible for any third party acts.
- This Promotion is subject to all applicable laws and regulations, including all liquor
licensing laws and regulations.
- The Promoter and its associated agencies and companies are not responsible for any
problems, delays or technical malfunction of any telephone or network or lines, servers
or providers, computer equipment, software, technical problems or traffic congestion on
a network or a mobile network or any combination thereof, or any other technical
failures including any damage to participant's or any other person's mobile handset,
computer or peripherals related to, or resulting from, participation in this promotion or
the downloading of any materials related to this promotion.
- If this Promotion is interfered with in any way or is not capable of being conducted as
reasonably anticipated due to any reason beyond the reasonable control of the
Promoter including because of war, terrorism, state of emergency or disaster (including
natural disaster), infection by computer virus, bugs, tampering, unauthorised
intervention, technical failures or any which corrupt or affect the administration,
security, fairness, integrity or proper conduct of this Promotion, the Promoter reserves
the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any
participant; or (b) subject to any written directions from a regulatory authority, to
modify, suspend, terminate or cancel this Promotion, as appropriate.
- The Promoter reserves the right to verify the validity of entries and reserves the right to
disqualify any participant for tampering with the entry process or for submitting an
entry which is not in accordance with these conditions of entry, or if the participant is
engaged in any unlawful or other improper misconduct calculated to jeopardize the fair
and proper conduct of the Promotion. The Promoter’s legal rights to recover damages
or other compensation from such an offender are reserved.
- The Promoter encourages responsible consumption of alcohol and recommends that
Church Road McDonald Series wines be enjoyed in moderation.
